Honourable Member Drags Constituent to Court For Demanding Accountability, Demands ₦5 Billion In Damages
The Honourable Member Representing Ukwa East/Ukwa West Federal Constituency,Hon Chris Nkwonta has instituted a ₦5 billion naira defamation lawsuit against one of his constituents, Comrade Ugwumba Adiele who demanded for accountability on the projects attracted by the Honourable Member to Ukwa Federal Constituency , in a case that is sparking debate on the limits of free speech and public accountability.
The suit, filed at the FCT High Court,Court 59,Asokoro Abuja accuses the constituent of making false and damaging statements regarding the handling of constituency projects wherein,the Honourable Member used his biological children as incorporated trustees to manage a federal government project.The lawmaker claims the remarks were published on social media and that they have caused reputational harm to his image.
The constituent,who has just been served with a writ of summon as instituted by the Honourable Member, has described the lawsuit as an attempt to suppress legitimate public scrutiny. He insists that his demand for transparency through legitimate questions, was made in good faith and in line with the constitutional right of citizens to hold public officials accountable for the use of public resources. His defence is expected to center on truth, fair comment, and qualified privilege, given that the matter concerns a public official’s conduct in office.
Legal analysts note that the outcome will hinge on whether the court finds the statements to be factual assertions or protected expressions of opinion on a matter of public interest. Under Section 377 of the Criminal Code Act, truth is an absolute defence if the publication was for the public good. Section 379 also provides conditional privilege for statements made in good faith on matters of public concern.
The ₦5 billion claim has drawn attention for its outrageous demand with observers saying it could have a devastating effect on citizens engagement if granted.
The hearing of the matter is billed to commence on the 3rd June,2026 in Abuja while both parties have indicated readiness to present evidences to back up their claims..
